How to make an AI email agent GDPR compliant#
If you're building an agent that sends or receives email, here's the short version:

The personal data your agent's email pipeline creates#
When a human sends an email, the data footprint is straightforward: sender, recipient, subject, body. When an AI agent sends email through an automated pipeline, the footprint expands.
Every outbound message generates delivery receipts with recipient server IPs, SMTP transaction logs with timestamps, bounce records that include the recipient's address and the reason for failure. If you're tracking opens, you also collect pixel beacon data that captures the recipient's IP, device type, and rough geolocation.
Under GDPR, all of this qualifies as personal data if it can be linked to an identifiable person. Email addresses make that linkage trivial.
The question isn't whether your agent handles personal data. It does. The question is whether you've mapped every place that data lands. Most teams account for their primary database and forget about queue logs, retry buffers, and the analytics pipeline quietly storing open-rate data in a third-party system.

Lawful basis: transactional vs. marketing vs. everything in between#
GDPR requires a lawful basis for every instance of personal data processing. For email, three bases come up repeatedly.
The clearest case is consent. Under Article 6(1)(a), marketing emails, newsletters, and promotional outreach all require it. The consent must be freely given, specific, informed, and unambiguous. Pre-checked boxes don't count. Bundled consent ("agree to our terms AND receive our newsletter") doesn't count either. Your agent needs to store exactly when and how each recipient opted in.
Transactional emails fall under a different basis. Contractual necessity, Article 6(1)(b), covers order confirmations, password resets, and shipping notifications. You can't slip a marketing upsell inside a shipping notification and call the whole thing "transactional."
The grey area is legitimate interest. Under Article 6(1)(f), you can sometimes justify service notifications, security alerts, and account updates without explicit consent. But you'll need a documented Legitimate Interest Assessment (LIA) that balances your interest against the recipient's rights. Regulators expect this in writing, not as an afterthought.
For AI agents, the tricky part is classification. If your agent autonomously decides to send a follow-up email, what category does that fall into? The lawful basis depends on the content and purpose of each individual message, not a blanket policy applied to all outbound email. Your agent needs logic that classifies each send before it happens.
Suppression lists and the right to erasure#
When someone unsubscribes or requests data deletion, your agent must stop contacting them. Sounds simple. It isn't.
The challenge is propagation. A suppression list only works if every system that can trigger an email checks it first. If your agent uses multiple sending paths (a transactional service, a marketing platform, a notification queue), each one needs real-time access to the same suppression data. A recipient who unsubscribes through one channel and then gets emailed through another has a valid GDPR complaint.
Right-to-erasure requests (Article 17) are harder. You need to delete the person's data from your primary database, your email logs, your bounce records, your analytics store, and any vector embeddings or conversation history that contain their information. For AI agents that store email content in retrieval systems, this means building deletion logic that reaches into every downstream system.

Data residency and cross-border transfers#
If your AI agent is hosted in the US and sends email to EU residents, you're transferring personal data outside the EU. Post-Schrems II, this requires Standard Contractual Clauses (SCCs) and a Transfer Impact Assessment (TIA) documenting that the destination country provides adequate data protection.
This isn't theoretical. The Austrian DPA ruled in 2022 that using Google Analytics transferred EU personal data to the US in violation of GDPR. Email infrastructure creates the same exposure, often with more granular personal data than a web analytics pixel.
Where your email pipeline lives matters. Where your logs are stored matters. Where your bounce processing happens matters. If any of these touch a non-EU server, you need SCCs with that provider and a documented TIA on file.
Why agent-first architecture changes the compliance picture#
Traditional email setups assume a human is making decisions: who to email, what to send, when to stop. GDPR was written with this model in mind. When an agent makes those decisions autonomously, the compliance burden shifts.
Under Article 22, data subjects have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. If your agent decides who gets emailed and what they receive, you need a mechanism for human review of those decisions.
